These Terms of Service govern your access to and use of the website, landing pages, forms, advertising campaigns, lead generation services, referral services, communications, and other services operated by Glacier Financial ("Glacier Financial," "Glacier," "we," "us," or "our").

By accessing our website, submitting an inquiry, completing a form, requesting information, responding to an advertisement, or otherwise using our services, you acknowledge that you have read, understood, and agreed to these Terms of Service.

1. Our Role

Glacier Financial is a lead generation and referral business.

We generate, collect, organize, qualify, and refer prospective customer inquiries relating to various residential and commercial financial products and services.

Depending on the campaign, these services may include inquiries relating to:

• Private lending
• Business financing
• Commercial financing
• Personal loans
• Lines of credit
• Debt consolidation
• Refinancing
• Home equity financing
• Construction financing
• Equipment financing
• Investment related services
• Insurance related services
• Other residential or commercial financial products and services

The actual products and services available through a particular campaign may vary.

Unless expressly stated otherwise, Glacier Financial is not the lender, financial institution, mortgage lender, mortgage brokerage, insurance company, investment dealer, bank, credit union, financial advisor, accountant, lawyer, or other regulated financial services provider responsible for providing the financial product or advice you may ultimately receive.

Glacier Financial's role is generally to generate and refer leads to independent third party partners.

2. No Financial Advice

Information provided by Glacier Financial through its website, advertisements, landing pages, forms, emails, telephone communications, or other marketing materials is intended primarily for general informational and lead generation purposes.

Unless expressly stated otherwise and legally authorized, Glacier Financial does not provide:

• Investment advice
• Mortgage advice
• Credit advice
• Tax advice
• Legal advice
• Insurance advice
• Accounting advice
• Lending decisions
• Credit approvals
• Underwriting decisions
• Financial product recommendations

3. Independent Partners

Glacier Financial may refer leads to independent third party businesses, professionals, lenders, brokerages, financial service providers, advisors, agents, or other organizations ("Partners").

Partners are independent businesses and are not employees, agents, representatives, or joint ventures of Glacier Financial unless expressly stated otherwise in writing.

Glacier Financial does not control the policies, practices, qualifications, licensing, products, rates, fees, underwriting criteria, approval decisions, advice, recommendations, or conduct of Partners.

A referral by Glacier Financial does not constitute an endorsement, guarantee, certification, or recommendation of a Partner.

You are responsible for conducting whatever investigation or due diligence you consider appropriate before entering into a financial relationship with a Partner.

4. Financial Products and Services

Financial products and services are subject to eligibility requirements, underwriting criteria, approval requirements, documentation requirements, applicable laws, and the policies of the relevant provider.

Glacier Financial does not guarantee that you will:

• Qualify for a financial product
• Receive financing
• Receive a particular interest rate
• Receive a particular loan amount
• Receive a particular credit limit
• Receive approval
• Receive a particular term
• Receive a particular financial product
• Receive a particular insurance policy
• Receive a particular investment opportunity
• Receive financing within a particular timeframe
• Receive any offer from a Partner

All final decisions concerning financial products and services are made by the applicable Partner or financial institution.

5. No Guarantee of Approval

Submitting a form or inquiry to Glacier Financial does not constitute an application for credit, a mortgage, insurance, investment product, or any other financial product unless expressly stated otherwise.

A lead submission does not guarantee approval or eligibility.

Any application that you subsequently submit to a Partner will be governed by the terms and policies of that Partner.

6. Information Provided Through Our Website

We attempt to provide useful and accurate information, but financial products, rates, eligibility requirements, regulations, lending criteria, fees, and other financial conditions can change.

Glacier Financial does not guarantee that information displayed on our website or advertisements is complete, current, or applicable to your specific circumstances.

Any examples, estimates, rates, payment amounts, financing amounts, savings figures, or other financial information should be considered illustrative unless expressly confirmed by an appropriately authorized provider.

7. Third Party Partner Relationships

Glacier Financial may receive compensation from Partners for leads, referrals, introductions, marketing services, advertising services, or other business services.

Where required by applicable law or regulation, applicable compensation, referral arrangements, relationships, or conflicts will be disclosed. For example, Ontario mortgage regulation contains specific disclosure requirements concerning remuneration and referral compensation in mortgage transactions.

The fact that Glacier Financial may receive compensation does not mean that Glacier Financial is responsible for the financial product ultimately provided by a Partner.

8. Lead Generation Services

Glacier Financial may use advertising, marketing, search engine optimization, paid search, social media, landing pages, referral arrangements, email campaigns, content marketing, and other methods to generate prospective customer inquiries.

A lead may be generated through:

• Google Ads
• Microsoft Advertising
• Meta (Facebook, Instagram)
• TikTok
• Search engines and organic search
• Partner websites and referral partners
• Landing pages, email campaigns, direct marketing
• Other advertising platforms and marketing channels

Glacier Financial does not guarantee that submitting an inquiry will result in contact from a Partner or the availability of any particular financial product.

9. Submission of Information

When submitting information to Glacier Financial, you agree that the information you provide is accurate, complete, and current to the best of your knowledge.

You agree not to provide false, fraudulent, misleading, or unauthorized information. You represent that you have the authority to provide any business or contact information submitted through our services.

10. Sharing Information With Partners

A primary purpose of Glacier Financial's services is to connect prospective customers with appropriate Partners.

By submitting an inquiry, you acknowledge that the information you provide may be shared with one or more Partners capable of responding to the type of service you requested. Depending on the particular campaign and the consent obtained, information may include:

• Name, Telephone number, Email address
• City or general location
• Property information
• Employment and Business information
• Financing requirements, general income, debt, and credit related information
• Loan requirements and other information you voluntarily provide

The specific information collected and shared will depend on the particular financial service being requested. Our Privacy Policy provides additional information concerning the collection, use, and disclosure of personal information.

11. Sensitive Financial Information

Financial information can be sensitive personal information. You should only provide information that is reasonably necessary for your inquiry.

Unless expressly requested through a secure application provided by an appropriate financial institution or Partner, you should not submit: Banking passwords, Online banking login credentials, Credit card passwords, Security questions or answers, Government account passwords, Full banking credentials, Cryptocurrency wallet credentials, or Other authentication credentials.

Glacier Financial will not request your passwords or security credentials through ordinary website lead forms.

12. Partner Communications

After submitting an inquiry, you may be contacted by Glacier Financial and/or one or more Partners. Partner communications may occur by Telephone, Email, Text message, or Other electronic communications.

The nature and frequency of communications may depend on your inquiry and the Partner receiving your information. Where required by applicable law, appropriate consent will be obtained before commercial electronic messages are sent.

13. Consent to Contact

By submitting a lead form, you acknowledge that Glacier Financial and, where applicable, the Partner or Partners receiving your inquiry may contact you regarding the service or financial product you requested information about.

Depending on the form and campaign, contact may occur by telephone, email, text message, or other permitted communication methods. Any marketing consent that is optional will be identified separately where required. You may withdraw marketing consent in accordance with applicable law.

14. Electronic Communications

You acknowledge that communications with Glacier Financial and its Partners may occur electronically. Electronic communications may include information relating to your inquiry, appointments, requests, applications, documentation, or other services.

You are responsible for ensuring that the contact information you provide is accurate. Glacier Financial does not guarantee that electronic communications will always be delivered without delay or interruption.

15. Third Party Applications

A Partner may ask you to complete a separate application, provide additional information, upload documentation, consent to a credit check, or enter into a separate agreement.

Any such application or agreement is between you and the applicable Partner. Glacier Financial is not responsible for the Partner's application process, privacy practices, underwriting process, approval decision, fees, rates, terms, or contractual obligations.

16. Credit Checks

Glacier Financial does not represent that submitting a basic inquiry to us will automatically result in a credit check.

If a Partner requires a credit report or other credit information, the Partner should provide the applicable disclosure and obtain any consent required by law before conducting the relevant check. Glacier Financial does not guarantee the outcome of any credit assessment.

17. Property and Mortgage Information

Where an inquiry relates to residential or commercial real estate financing, Glacier Financial may collect general information concerning the property or proposed transaction, including:

• Property type and location
• Estimated property value and purchase price
• Mortgage amount, existing financing, down payment
• Refinancing and construction requirements
• Commercial property information and intended use

Glacier Financial does not independently verify the accuracy of property information submitted by a prospective customer unless expressly stated otherwise.

18. No Guarantee of Rates

Any interest rate, payment amount, financing amount, term, fee, or other financial figure displayed in Glacier Financial advertising or marketing material may be subject to conditions, eligibility requirements, market conditions, lender criteria, and change.

A rate or financial figure shown in an advertisement does not constitute a binding offer unless expressly stated otherwise by the applicable authorized financial provider. You should confirm all financial terms directly with the applicable Partner before entering into an agreement.

19. No Guarantee of Partner Conduct

Glacier Financial does not guarantee that a Partner will:

• Contact you or respond within a particular timeframe
• Approve your application or offer financing
• Offer a particular product or rate
• Provide advice suitable to your circumstances
• Complete a transaction or provide a particular level of service
• Honour an advertised offer

Partners are independently responsible for their own conduct, products, services, advice, applications, agreements, and regulatory obligations.

20. Regulatory Status

Glacier Financial's role may differ from that of the financial professionals or businesses to whom leads are referred. Unless expressly stated otherwise, Glacier Financial does not represent that it is licensed or registered to provide the regulated financial service described in a particular advertisement or campaign.

Where a financial service requires a licensed or registered professional, the applicable Partner is responsible for providing that regulated service in accordance with applicable law. Nothing in these Terms authorizes Glacier Financial to perform an activity for which a licence, registration, approval, or other authorization is legally required.

21. Advertising and Marketing Information

Glacier Financial may create advertisements and marketing materials based on information provided by Partners, publicly available information, market information, or other sources. We seek to avoid false or misleading advertising but do not guarantee that all third party information will remain current.

Financial products and advertising claims may be subject to additional regulatory requirements. Where applicable, Partners remain responsible for ensuring that their regulated financial services and associated advertising comply with the laws and regulatory requirements applicable to them (e.g., FSRA requirements in Ontario).

22. Third Party Websites

Our website may contain links to websites operated by Partners or other third parties. Glacier Financial does not control those websites. We are not responsible for their Content, Privacy practices, Security, Financial products, Services, Terms, Fees, Advertising, Applications, or Business practices.

Your use of a third party website is governed by that website's terms and policies.

23. No Warranties

To the maximum extent permitted by applicable law, Glacier Financial's website and lead generation services are provided on an "as is" and "as available" basis. Glacier Financial does not warrant that:

• The website will always be available or operate without interruption
• Information will always be complete or current
• Leads will result in transactions or Partners will contact you
• Financial products will be available or you will qualify for one
• Any advertisement, rate, fee, payment, or financing amount will remain unchanged

Nothing in these Terms excludes or limits a warranty, right, or remedy that cannot legally be excluded or limited.

24. Limitation of Liability

To the maximum extent permitted by applicable law, Glacier Financial and its owners, directors, officers, employees, contractors, affiliates, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising from or relating to your use of our website, submission of an inquiry, referrals, Partner conduct, credit decisions, financial losses, lost profits, application delays, or third party website failures.

To the maximum extent permitted by law, Glacier Financial's total aggregate liability arising out of or relating to its website or lead generation services will not exceed the amount, if any, actually paid directly to Glacier Financial by you for the specific service giving rise to the claim during the twelve month period preceding the event giving rise to the claim.

25. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Glacier Financial and its representatives from claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your breach of these Terms, misuse of our website, fraudulent conduct, violation of applicable law, or your interactions with a Partner (except to the extent caused by Glacier Financial's own conduct).

26. Prohibited Activities

You agree not to use Glacier Financial's website or services to:

• Provide fraudulent or unauthorized information
• Impersonate another person
• Submit repeated or automated inquiries for improper purposes
• Attempt to obtain financial products through fraudulent means
• Circumvent security measures, scrape data, or introduce malicious software
• Harass Partners or violate applicable law

27-30. Privacy, Data & Records

Glacier Financial collects, uses, and discloses personal information in accordance with its Privacy Policy. Information submitted may be retained by Glacier Financial for legitimate business, legal, and operational purposes. A lead submission does not create an ownership interest in Glacier Financial or any Partner.

Glacier Financial does not guarantee that every lead will be qualified, exclusive, or result in a transaction. We may maintain records of inquiries and communications to establish the existence and terms of interactions.

31-36. General Provisions

Changes to Terms: Glacier Financial may modify these Terms. Updated Terms will be posted with a revised "Last Updated" date. Continued use constitutes acceptance.

Governing Law: These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada.

Severability & Waiver: If any provision is unenforceable, the remaining provisions remain in full force. Failure to enforce a provision does not constitute a waiver.

Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement regarding your use of our website.
